Keyword & Backlink monitor - broken?

Certainly you know this tool
www digitalpoint com/tools/keywords/

I just checked the results of the positions of my website with the ones i get when I manually use google.

digitalpoint tells me I am on position 42, my competitor on 40.
Google shows him on 4 and us on 40.

I know about the differences between different data centers but is this an explanation for such a difference?

Or did I miss somenthing out?
