Perhaps you are talking about trademark.

You can "own" almost any word or combo of words. This is done the easiest with a trademark/service mark but to get one or two words copyrighted is hard, infact I don't think its possible as copyrights only apply to original work and to be an original work with just two words would be hard.
But remember a trademark/service mark doesn't give you complete control over that name, as for example there are over a dozen registered trademark holders for the name "microsoft" as a trademark/server mark only is classed to one type of product or service so you could open a bar and call it "microsoft" or start selling a beer called "microsoft" then maybe we'd all be able to stand using it. |

Or if a company called you and asked you to "buy" keywords....Run away. There are a lot of companies selling keywords. They are similar systems to AOL's keyword program. Someone just types in a word and it automatically goes to your site. The problem is, this has never caught on outside of AOL so you are extremely unlikely to get anything out of your purchased keywords.

i wouldnt ever be told my words, id rather make my own way, and lol free porn thats been thought of before.
So yea, trademarking, owning a website name isnt the same as trademarking right? thats a totally new legal procedure i think, or its sounds like it, i wouldnt ever rip off a company but it just struck my attention and made me think about what is actually owning a set of keywords Has anyone ever trade marked anything before? did it go well? Didn't Donald Trump attempt to trademark the word "Trump" (subsequently sending shockwaves through euchre communities across the globe)?
If memory serves me correctly, he was unsuccessful. Nonetheless, this didn't stop him from suing anyone he could find that had the word "Trump" as part of their business name. |

I have several in the works right now - it takes a long time. First you have research done to see if anyone else has registered the mark or has prior commercial use without registration. Then an application is filed with US Trademark Office and they take up to a year to research and approve. At that point you have a pretty good claim to use of the name - at least in your own business category. After that you have a five year wait to see if anyone challenges. If no successful challenges it's yours, lock, stock and barrel. I am not seeking these trademarks to make claim to a name - at least that is not my primary reason. I am doing it for protection. My goal is to build very strong sites with loads of inbound natural links. I want to be damn sure that I will never have to hand over a PR8 site to someone else because they were using the name before I did. |

currently drinking "google microsoft" beer
Sounds like it might be worth it in the long term aside from the 5 year wait thing, thats a bit of a put off, but thanks for the info... Id be doing it more for egols reasons, it would be sickening to see someone else with your ideas 7 years down the road Last edited by andy_f : March 20th, 2005 at 12:31 AM. |
