A thorough analysis of the symptoms (if any) you see, can help you predict a penalty.. For example, you are linking out to banned porno sites? casino sites probably? and many others.. for example, using the same anchor everytime to build a backlink..

@coolrider: its not about being banned.. its about being penalised. Your website can be penalised while being in the index at the same time.
