Duplicate content in flash?

On my domain, I have a flash site and a mirrored html site. Both sites have the same wording and information. The html site is not only for those with dial up or slow connections, but also to help with my seo since previously flash was not indexed. Now that flash is being indexed, do I need to rewrite the content on the flash and html sites to avoid being penalized for duplicate content? I want to keep the html side for those with slower connections.

Not wise to have mirror sites. If the flash content on your site is a tutorial, you can convert it into a movie file and configure it so that it gets downloaded only when the visitor clicks play. On the same screen you can have a link pointing to the html site if the visitor is on dial-up. Otherwise you can only compress it or convert png/bmp contents of flash into gif/jpg. Still better is to keep only the html site.

Unfortunately it's very common in my industry to have the flash site and the html site. People want the super cool flashy fancy site for impact, but we know we need the html for seo. Those with flash only sites rank low on the seo, but add on an html site with all the same information and you zoom on up. The website designers even sell them as flash with attached html because so many want it.

Previously it wouldn't have mattered since google wasn't indexing flash, but now that it is, I wonder if there will be penalties for all of us who have the flash and html and duplicate information.

Google claims they are indexing flash now. I have not seen any evidence that this is true showing up in the SERPs. Personally I would not worry about it.
